Does my California Designated Representative training affidavit count towards my Florida CDR license?

Question 


I have a California Designated Representative training affidavit.  Does it count toward my Florida Certified Designated Representative (CDR) license?

Answer  


No.  There is no reciprocation between California and Florida.  In other words, each state has their own unique licensing agency & processes, therefore, license applicants have to treat each state application process separately.

A Tip About Self-Study - California Designated Representative Training

Avoid Independent Self-Study In The Place Of An Approved Training Program


We've started hearing about California Designated Representative license applicants trying to fulfill the training program requirement on their own. Specifically, applicants are reviewing specified subjects and topics outlined on the California Designated Representative Training Affidavit form, and claiming their self-study constitutes completion of a training program.

Studying the specified subjects and topics by oneself, that is, independent self-studying, would not be considered completing a training program.  Even if the independent self-study was considered a training program, such a self-study training program would still need to gain California State Board of Pharmacy ("Board") approval.

In general, the Board is unlikely to accept the submission of a California Designated Representative Training Affidavit signed by the applicant, or by a person or entity offering a training program that has not been approved by the Board. Sending in such a deficient Training Affidavit form is likely to delay license application processing.

California Designated Representative training programs must undergo an assessment and review by the Board before being considered for approval.  Approved California Designated training programs meet the Board's rigorous standards, ensuring the training provider covers all required subjects and topics, and that some form of assessment or grading (such as exams) is incorporated into the training program.

In Summary


Don't confuse independent self-study with Board approved training programs that are offered as an online course. In a nutshell, independent self-study isn't the same as self-study-paced online coursework in a Board approved training program, course, or class.

When I applied for my California Designated Representative license, I had to complete a required training course, and I submitted a training affidavit in my license application. Should I worry about ongoing training?

Answer


At the time this answer was written, ongoing training requirements are not mentioned in the Designated Representative request for license renewal form.  However, here’s something you might want to consider. Your employer is likely required to complete one of the Board’s facility self-assessment forms.  One self-assessment question is, ”Are training and experience provided to all employees to assure all personnel comply with all licensing requirements? (CCR 1780[f][4])”  This question suggests that ongoing training is expected.

California Designated Representative Training Requirements

If you're new to the world of the California Designated Representative, maybe this quick introduction will help. I'm going to explain, using the California State Board of Pharmacy as the example.

To be licensed as a Designated Representative [wholesaler] in California, you must satisfy the requirements under Business and Professions Code section 4053. Wholesale operations that distribute dangerous drugs or dangerous devices must be supervised by a registered pharmacist or an individual approved by the Board as a designated representative. These companies may not operate unless the pharmacist or designated representative is physically on the licensed premises. To ensure proper control at all times, the Board recommends that there be more than one person approved to supervise operations.

There are quite a number of requirements that have to be met in order to qualify, including the following training requirements listed on the California Designated Representative (wholesaler) application form:

"The individual applying for a designated representative [wholesaler] license in California has completed a training program required by Section 4053(b)(3) of the California Business and Professions Code that addressed, at a minimum:

A. Knowledge and understanding of California and federal laws regarding the distribution of dangerous drugs and dangerous devices;
B. Knowledge and understanding of California and federal laws regarding the distribution of controlled substances;
C. Knowledge and understanding of quality control systems;
D. Knowledge and understanding of United States Pharmacopoeia standards for the safe storage and handling of drugs; and
E. Knowledge and understanding of prescription terminology, abbreviations, dosages and format."
